1. Agreement to Terms
By accessing or using the Nexum platform, website, or services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
2. Description of Services
Nexum operates an invite-only affiliate marketing network specializing in business opportunity (BizOpp) offers. Our services include:
- • Affiliate marketing platform connecting publishers and advertisers
- • Performance tracking and attribution services
- • Payment processing and commission management
- • Marketing tools and campaign optimization
- • Account management and support services
3. Account Registration and Eligibility
Invite-Only Access
Access to the Nexum platform is by invitation only. We reserve the right to approve or reject any application at our sole discretion.
Eligibility Requirements
To be eligible for the platform, you must:
- • Be at least 18 years of age
- • Have legal capacity to enter into binding contracts
- • Provide accurate and complete registration information
- • Comply with all applicable laws and regulations
- • Meet our performance and quality standards
Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- • Fraudulent or deceptive marketing practices
- • Spam, unsolicited communications, or violations of anti-spam laws
- • Cookie stuffing, click fraud, or other invalid traffic generation
- • Trademark or copyright infringement
- • Promotion of illegal or harmful products or services
- • Circumventing or attempting to circumvent our tracking systems
- • Sharing account access or login credentials
- • Reverse engineering or attempting to access our proprietary systems
5. Payment Terms
Publisher Payments
Elite affiliates receive twice-weekly payouts subject to minimum thresholds and performance verification. All commissions are subject to our approval process and quality assurance checks.
Payment Processing
Payments are processed according to our standard payment schedule. We reserve the right to hold payments pending investigation of suspicious activity or compliance issues.
Chargebacks and Reversals
You may be liable for chargebacks, refunds, or reversals related to your promotional activities. We may deduct such amounts from future payments.
6. Intellectual Property
All content, trademarks, and intellectual property on the Nexum platform remain the property of Nexum Technologies Ltd or our licensors. You may use our marketing materials solely for approved promotional activities in accordance with our brand guidelines.
7. Data and Privacy
Your use of our services is subject to our Privacy Policy, which is incorporated into these terms by reference. You agree to comply with all applicable data protection laws and regulations in your promotional activities.
8. Termination
Either party may terminate this agreement at any time with or without cause. Upon termination:
- • Your access to the platform will be immediately suspended
- • All outstanding payments will be processed according to our standard schedule
- • You must cease all promotional activities using our materials
- • Confidentiality and non-disclosure obligations will survive termination
9. Disclaimers and Warranties
THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
IN NO EVENT SHALL NEXUM TECHNOLOGIES LTD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
11. Indemnification
You agree to indemnify and hold harmless Nexum Technologies Ltd from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.
12. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
13. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting. Your continued use of the platform constitutes acceptance of any changes.
